I will NOT share your personal data with third-parties unnecessarily.  I may disclose your personal data for the purposes set out in this Privacy Policy:

  •  ~  If I am under a duty to disclose or share your personal data in order to comply with any legal obligation or to protect my rights, property, or safety, or the rights, property or safety of my customers, or others.  This includes exchanging information with the police or other investigatory or law enforcement authorities and companies and organisations involved in fraud protection and credit risk reduction.

I may also share anonymous data to third-parties such as my advertisers; and analytics and search engine providers that assist us in the improvement and optimisation of my website.

 

This anonymous data will be collected using cookies in a way which alone cannot identify any individual.

 

I will never share your personal data with any company outside The Different Assistant for non-The Different Assistant related marketing purposes.

 

INTERNATIONAL TRANSFERS


The data that I collect from you will be stored on secure servers within the European Economic Area (“EEA)”.  The majority of such data is held within the UK.

 

Certain information may be accessed and processed by staff operating outside the EEA who work for me or for one of my suppliers.  Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services (such as content moderation or the maintenance of our data storage facilities).

 

Whenever I transfer your personal data out of the EEA, I ensure a similar degree of protection is afforded to it.

 

DATA SECURITY


I have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.  In particular, I use SSL to encrypt your information.

 

I have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where I am legally required to do so.

 

Please note that, despite the steps I take, the transmission of information via the internet can never be completely secure.  Although I will do my best to protect your personal data, I cannot guarantee the security of your data transmitted to my website.

 

DATA RETENTION


I will only retain your personal data for as long as necessary to fulfil the purposes I collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

 

To determine the appropriate retention period for personal data, I consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which I process your personal data and whether I can achieve those purposes through other means, and the applicable legal requirements.

 

By law I have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes.  I typically retain this information for a further six to twelve months to ensure that no relevant claim has been made within that six year period before I dispose of it.

 

In some circumstances I may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case I may use this information indefinitely without further notice to you.

Under certain circumstances, you have rights under data protection laws in relation to your personal data. You have the right to request access to the personal data I hold about you and to check that I am lawfully processing it.  You also have the right to request correction of the personal data that I hold about you.  This enables you to have any incomplete or inaccurate data I hold about you corrected, though I may need to verify the accuracy of the new data you provide to me.

 

You have the right to request I erase your personal data.  This enables you to ask me to delete or remove personal data where there is no good reason for me continuing to process it.  Please note, however, that I may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

 

You have the right to object to me processing your personal data where I am relying on a legitimate interest (or those of a third-party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms.  In some cases, I may demonstrate that I have compelling legitimate grounds to process your information which override your rights and freedoms.

 

You have the right to request I restrict the processing of your personal data.  This enables you to ask me to suspend the processing of your personal data if you want me to establish the data’s accuracy; where my use of the data is unlawful but you do not want me to erase it; where you need me to hold the data even if I no longer require it as you need it to establish, exercise or defend legal claims; or you have objected to my use of your data but I need to verify whether I have overriding legitimate grounds to use it.

 

You have the right to request I transfer your personal data to you or to a third-party. I will provide to you, or a third-party you have chosen, your personal data in a structured, commonly used, machine-readable format.  Note that this right only applies to automated information which you initially provided consent for me to use or where I used the information to perform a contract with you.

 

You have the right to withdraw your consent to processing where I am relying on that consent to process your personal data.  However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.  If you withdraw your consent, I may not be able to provide certain products or services to you.  I will advise you if this is the case at the time you withdraw your consent.

 

You will not have to pay a fee to access your personal data (or to exercise any of the other rights).  However, I may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive.  Alternatively, I may refuse to comply with your request in these circumstances.

 

I may need to request specific information from you to help me confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights).  This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.  I may also contact you to ask you for further information in relation to your request to speed up my response.

 

I try to respond to all legitimate requests within one month.  Occasionally it may take me longer than a month if your request is particularly complex or you have made a number of requests.  In this case, I will notify you and keep you updated.
